1. Introduction
Welcome to Tastes of Vallarta ("we," "us," or "our"). We are a tour booking service located in Puerto Vallarta, Mexico. Please read these Terms and Conditions carefully before using our services.
2. Nature of Services
2.1. We operate as a booking agent and intermediary service only. We do not own, operate, or maintain any boats, yachts, or water vessels.
2.2. All marine vessels and tours are operated by independent third-party operators ("Operators") who maintain their own licenses, insurance, and operating permits.
2.3. We facilitate bookings between customers and these independent Operators but are not responsible for the operation of any tours or vessels.
3. Assumption of Risk
3.1. Customer acknowledges that ocean activities and marine tours involve inherent risks, including but not limited to:
- Changes in weather conditions
- Rough seas and wave action
- Motion sickness
- Risk of drowning
- Marine life encounters
- Accidents or collisions
- Medical emergencies with limited access to immediate care
- Equipment failure
- Actions of other participants
3.2. Customer voluntarily assumes all risks associated with participating in ocean activities and marine tours.
4. Release of Liability
4.1. By booking through our service, customers agree to release PV Experiences from any liability related to:
- Actions or negligence of third-party Operators
- Weather-related cancellations or modifications
- Personal injury or death
- Loss or damage of personal property
- Changes in itinerary
- Mechanical failures
- Any incidents occurring during the tour
5. Health and Safety Requirements
5.1. Customers must:
- Be in good physical health
- Know how to swim
- Disclose any medical conditions that may affect their safety
- Follow all safety instructions provided by Operators
- Not be under the influence of alcohol or drugs before or during tours
6. Bookings and Cancellations
6.1. All bookings are subject to availability and weather conditions.
6.2. Cancellation policies:
- Full refund for cancellations 72 hours or more before tour date
- 50% refund for cancellations 24-72 hours before tour date
- No refund for cancellations less than 24 hours before tour date
- Full refund if tour is cancelled by Operator due to weather or safety concerns
7. Weather and Sea Conditions
7.1. All tours are subject to weather and sea conditions. Operators maintain sole discretion to modify or cancel tours based on safety considerations.
7.2. Weather-related cancellations will result in full refunds or rebooking options.
8. Personal Property
8.1. Customers are responsible for their personal belongings during tours.
8.2. We recommend not bringing valuable items on tours.
8.3. Neither Tastes of Vallarta nor the Operators are responsible for lost, damaged, or stolen items.
## 9. Photography and Marketing
9.1. Operators may take photographs during tours for marketing purposes.
9.2. Customers grant permission for use of their likeness in promotional materials unless explicitly stating otherwise.
## 10. Jurisdiction and Governing Law
10.1. These terms are governed by the laws of Mexico.
10.2. Any disputes shall be subject to the exclusive jurisdiction of the courts in Puerto Vallarta, Jalisco, Mexico.
